Florida Law

Florida passed a special law to deal with ridesharing companies such as Uber which is applicable in all cases where an Uber driver is involved in an accident.  Florida law CS/HB 221 of 2017 stipulates that each driver should carry a minimum insurance coverage of $1 million which must also include property damage, bodily injuries, and death benefits.

You must also be mindful of the Florida statute of limitations which allows you to file a claim for injury within 4 years after the accident.  A claim filed after the statute of limitations will not be admitted by Florida courts.

Uber App On/Off

Uber insurance policy which has a minimum limit of $1 million in total damages will not be applicable if the Uber app is off or the driver has not officially accepted a passenger using his Uber app/device.
